Terms of Service

1. Definitions

The following terms carry specific meaning throughout this agreement.

• "Company", "we", or "us" means Triad Holdings Group, operating the Elysian Interactive Systems brand.
• "Services" means Elysian CAD, the ESD Portal, Elysian Command, Elysian GoLive V1, the Elysian Suite, custom engineering work, and media production work.
• "Customer" means the individual or organization that holds the billing account.
• "End Users" means members, staff, and roster participants the Customer grants access to a portal or workspace.
• "Customer Data" means all content, rosters, records, media, and configuration a Customer or its End Users submit to the Services.

2. Eligibility And Accounts

You must be at least 13 years old to hold an Elysian account, and at least 18 years old to hold a billing account or enter a professional services agreement. If you accept these terms for an organization, you confirm you are authorized to bind that organization.

You are responsible for the accuracy of your account details, for the security of your credentials, and for all activity occurring under your account. Notify us immediately if you suspect unauthorized access. We may suspend an account where we reasonably believe credentials have been compromised.

3. Subscriptions, Trials, And Renewals

Plans are sold on monthly or annual terms and renew automatically at the then current rate until cancelled. Eligible standalone plans include a seven day free trial, and no charge occurs during the trial period unless you upgrade early.

Renewal charges are processed against the payment method saved at checkout on the day the current period ends. If a renewal fails, the subscription is marked past due, access may be restricted, and further attempts may be made before the plan is suspended. You may cancel renewal at any time from your dashboard, and access continues through the end of the period already paid for.

• Seat and add-on changes are applied to the account immediately and reflected on the next renewal.
• Price changes are communicated before they take effect and apply from the following renewal.
• Cancelled portals retain setup data for sixty days, after which the workspace may be permanently deleted.

4. Payments, Taxes, And Chargebacks

Payments are processed by Square. Card details are captured and stored by the payment processor and never held on Elysian servers. All prices are listed in United States dollars unless stated otherwise.

Applicable sales, use, or value added tax is calculated from the billing address provided at checkout and added at the time of payment. You are responsible for supplying an accurate billing address. Where a chargeback is filed without first contacting support, we may suspend the account until the dispute is resolved.

5. Acceptable Use

The Services exist to support organized roleplay and community operations. You agree not to use them for any of the following.

• Unlawful activity, harassment, threats, hate speech, or targeting of real individuals.
• Storing real world personally identifiable information about third parties without a lawful basis and their consent.
• Reverse engineering, scraping, load testing, or attempting to bypass access controls or rate limits.
• Reselling, sublicensing, or white labelling the Services outside an Enterprise Network plan that expressly permits it.
• Uploading malware, or using broadcast features to distribute infringing or explicit content.

6. Customer Data And Ownership

You retain all right, title, and interest in Customer Data. You grant us a limited licence to host, process, transmit, and display that data solely to operate and support the Services.

We retain ownership of the Elysian platform, its source code, interfaces, documentation, and brand assets. Feedback and feature requests you submit may be implemented without restriction or compensation, and do not transfer ownership of your data.

7. Availability And Support

We target high availability but do not guarantee uninterrupted service on Starter or Department Pro plans. Planned maintenance is announced in advance where practical. Enterprise Network plans include a dedicated service level commitment agreed in writing.

Support is delivered through community channels on Starter, priority Discord ticketing on Department Pro, and dedicated round the clock response on Enterprise Network.

8. Third Party Services

The Services interoperate with platforms including Discord, FiveM servers, Square, and streaming providers such as OBS and Twitch. Those platforms are governed by their own terms, and we are not responsible for their availability, pricing, or policy changes. Integration features may change when an upstream provider changes its interfaces.

9. Professional Services And Contractors

Custom engineering and media production work is quoted per project with a defined scope, deliverables, and amount. Work begins once the scope is agreed and any deposit is received. Contractors delivering work through the Elysian network operate under a documented seventy five to twenty five revenue share with manual payout records.

Unless a written agreement states otherwise, deliverables transfer to the Customer on final payment, while underlying tooling, libraries, and frameworks remain the property of Triad Holdings Group.

10. Suspension And Termination

We may suspend or terminate access for non payment, breach of acceptable use, abuse of staff, or activity that creates legal or security risk. Where practical we provide notice and an opportunity to remedy the issue.

You may terminate at any time by cancelling your plan. Termination does not entitle you to a refund except as described in the Refund Policy.

11. Disclaimers And Limitation Of Liability

The Services are provided on an as is and as available basis without warranties of any kind, whether express or implied, including fitness for a particular purpose. Roleplay records created in the Services carry no legal or evidentiary standing in the real world.

To the maximum extent permitted by law, the total aggregate liability of Triad Holdings Group arising from this agreement is limited to the amounts you paid for the Services in the twelve months preceding the claim. We are not liable for indirect, incidental, or consequential loss, including lost community membership, lost revenue, or lost data where backups were available.

12. Indemnity

You agree to indemnify and hold harmless Triad Holdings Group against claims, damages, and reasonable costs arising from your Customer Data, your use of the Services in breach of these terms, or your violation of the rights of a third party.

13. Changes, Governing Law, And Notices

We may update these terms to reflect new features, legal requirements, or operational practice. Material changes are announced before taking effect, and continued use after that date constitutes acceptance.

This agreement is governed by the laws applicable to the registered seat of Triad Holdings Group, and the parties submit to the exclusive jurisdiction of its competent courts. Notices to us may be sent through the official Elysian Discord support channel and will be acknowledged in writing.
